These Terms of Service ("Terms") govern your access to and use of Sketchie, an AI service that turns a text prompt or document into a narrated, whiteboard-style explainer video ("Sketchie", the "Service"). Sketchie is operated by Downshift LLC, 520 Broadway #200, Santa Monica, CA 90401 ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Sketchie generates narrated explainer videos, along with an editable scene graph, from the prompts and documents you provide. Output is produced by automated systems. It can contain mistakes, and it is your responsibility to review any video before you rely on it or publish it.
You create an account with an email and password or by signing in with Google. You must verify your email address before you can use the Service. You must give accurate information and keep your login secure. You are responsible for everything that happens under your account.
You must be at least 13 years old to use Sketchie, and old enough to enter into a binding contract where you live. If you use Sketchie for an organization, you confirm you are allowed to accept these Terms on its behalf.
Sketchie is free to start. You create an account with no payment method. After you verify your email, every account gets 2 free videos, each up to 1 minute long. Free videos include a Sketchie watermark.
Prices and plan details are shown on our pricing page and may change over time. If we change the price of your plan, we will give you notice before the change applies to a renewal.

You keep ownership of the prompts and documents you submit ("Inputs") and, as between you and us, the videos and scene graphs generated for you ("Outputs"). You are responsible for having the rights to your Inputs and for how you use your Outputs.
You grant us the limited license needed to host, process, transmit, and display your Inputs and Outputs so we can operate and improve the Service, including sending them to the third-party processors described in our Privacy Policy. If you choose to share or export a video, you also grant us the license needed to store and serve that video from our public media system so it can be viewed by the people you share it with.
We do not use your Inputs or Outputs to train our own models.
Outputs are generated automatically and are provided without any warranty of accuracy, originality, or fitness for a particular purpose. Similar prompts may produce similar results for different users, and the Service does not guarantee that your Output is unique. Review Outputs before using them, especially for factual, legal, medical, or financial topics.
Some visual assets used in videos, such as icons, may be provided under open-source licenses that require attribution when you publish. Where that applies, we will make the attribution requirements available to you.
We rely on trusted service providers to run Sketchie, including for payments, storage, AI generation, narration, email, analytics, and error monitoring. Your use of the Service is also subject to those providers' terms where they apply to you. Our current list of these providers, and the data each one handles, is in our Privacy Policy.
API access requires a paid plan. On a paid plan, you can access Sketchie programmatically through our API and MCP interface using an API key. You are responsible for keeping your API key secret and for all use made with it. Do not share your key or embed it where others can extract it. We may rate-limit, suspend, or rotate keys to protect the Service.
The Service itself, including its software, models, design, and brand, is owned by us and our licensors. These Terms do not grant you any rights in the Service other than the right to use it as described here.
You may stop using Sketchie at any time and cancel from your billing settings. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service. If we end your access for a reason other than your breach, we will not charge you for a period you cannot use. On termination, your right to use the Service stops. Sections that by their nature should survive, such as ownership, disclaimers, limitation of liability, and indemnification, survive.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that Outputs will meet your requirements. Nothing in these Terms limits rights you have under mandatory consumer-protection law that cannot be waived.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
You agree to defend and hold us harmless from third-party claims arising out of your Inputs, your Outputs, or your misuse of the Service or violation of these Terms, to the extent permitted by law.
We may update these Terms as the Service evolves. If we make a material change, we will take reasonable steps to notify you, such as by email or an in-product notice. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not agree to a change, you can cancel and stop using the Service.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and we agree that any dispute will be handled by the state or federal courts located in Los Angeles County, California, unless mandatory local consumer law where you live gives you the right to bring a claim in your own courts or under your own law. Nothing here takes away a consumer-protection right you have that cannot be waived.
